IPEC CASE STATEMENT
Following on from the reasons stated on my landing page, I am taking an indefinite hiatus from shooting music due to my Sarah Ginn XX Sub Focus (Photography Concept Project) - IPEC Civil Copyright Infringement Claim.
Henceforth, my civil damages claim against the photographer Sam Neill (of Worship Artists and his own Contour Agency), for the alleged plagiarism and IP copyright breach of my ‘A Circular Light’ photography pitch (pitched in November 2021 - IP breach dated March 2023) has now luckily been passed to legal specialists to action. They will officially re-file my IPEC claim via his & Worship Artists nominated lawyers, Sound Advice LLP. This is once the particulars are completed (with new supporting information/evidence). Copyright infringement claims have 6 years from the date of infringement to make a claim so there is plenty of time to file. I’m exceptionally relieved about this, as I’m able to completely disengage and outsource its now become a non issue for me.
Currently there are no official arrests/court appearances/criminal convictions/charges/fines/community service/civil penalties of any kind on either side. There are also no gagging orders/NDAs to stop me stating my civil filing plans and details of it (as with the recent Domino Records VS Four Tet Civil Case, which was reported in the music press and via social media). Once the case is concluded, all evidence/details are available on public records as standard to view. This civil IP theft case is the only legal/criminal law issue between us all (good news for both parties). I look forward to settling this matter, whatever the outcome with respect/forgiveness and ultimately, kindness extending to all parties. It’s a real shame this occurred for all of us. Ultimately, Sub Focus would have been an exceptional artist for the XX concept and this is still one of the strongest pitches I’ve produced, theoretically and visually.
